Please read these Terms and Conditions carefully before using the website operated by Stib Ltd products. Without prejudice to the above, by using or accessing our website, you agree to be legally bound by these Terms and Conditions of use as they apply to your use of or access to our website. If you do not wish to be bound by these Terms and Conditions then you may not use our website.
By placing an order via our website (stibpencils.com), you are offering to purchase a product on and subject to the following terms and conditions. All orders are subject to availability and confirmation of the order price.
2. Pricing and Availability
While we try and ensure that all details, descriptions and prices which appear on this website are accurate, errors may occur. If we discover an error in the price of any goods which you have ordered we will inform you of this as soon as possible and give you the option of reconfirming your order at the correct price or cancelling it. If we are unable to contact you we will treat the order as cancelled.
The website may contain typographical errors or other errors or inaccuracies and may not be complete or current. We therefore reserve the right to correct any errors, inaccuracies or omissions and to change or update information at any time without prior notice. We reserve the right to refuse to fulfil any orders that you may place based on information on the website that may contain errors or inaccuracies, including, without limitation, errors, inaccuracies or out-of-date information regarding pricing, shipping, payment terms, or return policies.
You must pay for the Products by credit or debit card at the time of the order, at which time you will be notified of the current price. Stib Ltd is entitled to refuse any order placed by you. If your order is accepted, we will confirm acceptance to you by online electronic means (‘Confirmation’) to the e-mail address you have given us on ordering. The order will then be fulfilled by the date set out in the Confirmation. To cancel your order after it has been dispatched to you, you will need to follow the Refund Policy
You must be over 18 years of age to place an order and when doing so, you undertake that all details you provide to us are true and accurate, that you are an authorised user of the credit or debit card used to place your order and that there are sufficient funds to cover the cost of the goods. When you place an order, you will receive an acknowledgement confirming receipt of your order.
4. Refund Policy
Stib Ltd will provide a refund where:
(a) you have cancelled the Contract between us and returned the Product within 28 days if you are dealing as a consumer;
(b) a Product that you claim is defective or has been damaged in transport to you is returned to us within 14 days of delivery and is found by us to be defective or damaged in transport; or
(c) you notify us that you do not agree to a change in our Terms occurring between you placing your order and receiving a Dispatch Confirmation.
When you return a Product to us because you:
(a) have cancelled the Contract between us within the 28 days cancellation period, we will process the refund due to you as soon as possible and, in any case, within 30 days of the day you have given notice of your cancellation. In this case, we will refund the price of the Product in full. If you have returned the Product to us within the 7 day cooling off period that you are entitled to by law, we will also refund any delivery charges paid by you. However, you will be responsible for the cost of returning the item to us;
(b) claim that the Product is defective or has been damaged in transport, we will examine the returned Product and will notify you of your refund via e-mail within a reasonable period of time. We will usually process the refund due to you as soon as possible and, in any case, within 30 days of the day we confirmed to you via e-mail that you were entitled to a refund for the defective or damaged Product. Products returned by you because of a defect or damage in transport will be refunded in full, including a refund of the delivery charges for sending the item to you and the cost incurred by you in returning the item to us; or
(c) have notified us that you do not agree to a change in these Terms or in any related policies, we will process the refund due to you as soon as possible and, in any case, within 30 days of the day you have given notice. On condition that any Product dispatched to you is returned in the condition in which you received it, we will refund the price of the Product in full, including any delivery charges paid by you. However, you will be responsible for the cost of returning the item to us.
Any refund due to you will only be made to the same credit or debit card originally used (or in the form of other method of payment) by you to pay for your purchase
Products will be delivered as selected by you in the order process. Options include £2.90 for UK Standard Delivery (3-5 days) or £5.95 for UK Express Courier Service. For the Express service, orders need to be placed before noon and will arrive the following working day (NOT Including Saturday or Sunday) before 6pm. Orders placed before noon on a Friday will arrive the following Monday (excluding bank holidays). For orders over £36 there is no delivery charge.
Dispatch times may vary according to availability and any guarantees or representations made as to delivery times are subject to any delays resulting from postal delays or force majeure for which Stib Ltd will not be responsible.
6. Governed Law
Stib Ltd Terms and Conditions shall be governed by and construed in accordance with UK law.
We shall not be liable for incidental or consequential damages or expenses. This includes, but is not limited to, damage to property, lost income, profits, economic or commercial losses and third parties claims.
Stib Ltd uses the information we collect about you to process orders and provide our best service. We never sell or disclose any customer information to third parties and you can be confident your credit card details are safe. We send emails from time to time with product news and events but if you're not happy receiving them, let us know and we’ll remove you from our mailing list.
